A RESOLUTION AUTHORIZING THE

SETTLEMENT OF THE CLAIM OF

BENJAMIN SINGLETON

WHEREAS, on September 17, 2025, a Notice of Claim was filed by Benjamin Singleton against the City of Mount Vernon alleging that his personal vehicle, which was lawfully parked and unoccupied in his designated parking space at Fire Station No. 1, was struck by a Department vehicle from Fire Station No. 3 while backing up a fire truck due to a failure of the truck’s air brake system; and

WHEREAS, the claimant’s vehicle, a 2007 Mercedes-Benz CLK350, sustained damage to the front bumper, grille, headlights, radiator, and hood, with estimated repair costs totaling $9,987.52; and

WHEREAS, the claimant asserted that the vehicle was in excellent condition for its age prior to the incident and considered it a classic model; and

WHEREAS, following negotiations between the parties, the claimant agreed to resolve and settle the matter for the sum of $6,344.27; and

WHEREAS, upon review and evaluation of the claim, the Corporation Counsel, by correspondence dated March 6, 2026, recommended that the Board of Estimate and Contract approve the settlement in the amount of $6,344.27;

NOW, THEREFORE, BE IT

RESOLVED, that the Board of Estimate and Contract hereby authorizes the settlement of the claim filed by Benjamin Singleton in the amount of $6,344.27; and be it further

RESOLVED, that the Comptroller is hereby authorized and directed to issue payment in the amount of $6,344.27 from Budget Code A1930.494 (Judgments and Settlements) in the 2026 Budget.
