A RESOLUTION AUTHORIZING THE
SETTLEMENT OF THE CLAIM OF
GEICO GENERAL INSURANCE COMPANY
A/S/O RICHARD GARTH
WHEREAS, on March 9, 2018, Geico General Insurance Company, as subrogee of Richard Garth, filed a Notice of Claim against the City of Mount Vernon, seeking compensation of $4,583.97 for property damage to a 2012 Nissan Altima. The damage allegedly occurred on January 25, 2018, on Mersereau Avenue when a city-operated H-116 dump truck, driven by a municipal employee, backed into the vehicle; and
WHEREAS, on April 2, 2019, a federal lawsuit was initiated against the City of Mount Vernon on behalf of Geico General Insurance Company, as subrogee of Richard Garth; and
WHEREAS, by letter dated March 27, 2025, the Corporation Counsel has recommended that the Board of Estimate & Contract approve the settlement of this claim for $3,000.00; NOW, THEREFORE, BE IT
RESOLVED, that the claim of Geico General Insurance Company, as subrogee of Richard Garth, be settled for $3,000.00, with said settlement hereby approved; and be it further
RESOLVED, that this amount shall be disbursed from Budget Code A1910.469 (Insurance - Claims) in the 2025 Budget.
