WHEREAS, on February 5, 2020, STATE FARM FIRE AND CASUALTY COMPANY a/s/o RHOSHENA AND CORTNEY ALLEN filed a Notice of Claim seeking the sum of $5,266.79 which includes the plaintiff’s deductible of $1,731.00 against the City of Mount Vernon for property damage allegedly caused to the claimants’ home when a city sanitation truck somehow caught onto electric and/or cable wires attached to their home, ripping it from same causing gutter and siding damage on November 29, 2019 (the homeowners were apparently home at the time of the incident); and
WHEREAS, the City of Mount Vernon was served with a Summons and Complaint on March 1, 2021; and
WHEREAS, by letter dated November 17, 2023, the Corporation Counsel hereby recommends that the Board of Estimate & Contract approve the settlement of the aforesaid claim in the amount of $2,000.00; NOW, THEREFORE, be it
RESOLVED, that the aforesaid claim of STATE FARM FIRE AND CASUALTY COMPANY a/s/o RHOSHENA AND CORTNEY ALLEN, be settled for the sum of $2,000.00 and that said settlement be and the same hereby is approved; and be it further
RESOLVED, that said sum be paid out of Code A1910.469 (Insurance - Claims), 2023 Budget.
