A RESOLUTION AUTHORIZING
THE SETTLEMENT OF THE CLAIM OF
ABDONASSER ASHUBI
WHEREAS, on April 15, 2026, Abdonasser Ashubi filed a Notice of Claim against the City of Mount Vernon arising from an alleged incident that occurred on March 16, 2016, alleging that members of the Mount Vernon Police Department lost his cellular telephone while he was in police custody; and
WHEREAS, during a search incident to the claimant’s arrest, a police officer recovered the claimant’s cash and cellular telephone. The claimant’s wallet and cash were released to his girlfriend, who was authorized to take possession of the claimant’s vehicle. The claimant’s cellular telephone was inadvertently placed on the roof of the police vehicle during the arrest process and remained there while the vehicle was being driven. Upon realizing the oversight, the officer immediately returned to the location and conducted a search for the telephone; however, the telephone could not be located; and
WHEREAS, the claimant sought reimbursement for the alleged damages in the amount of One Thousand Five Hundred Ninety-Nine Dollars and Ninety-Nine Cents ($1,599.99); and
WHEREAS, upon review and evaluation of the claim, the Corporation Counsel, by correspondence dated August 5, 2026, recommended that the Board of Estimate and Contract approve a settlement in the amount of $850.00; and
NOW, THEREFORE, BE IT
RESOLVED, that the Board of Estimate and Contract hereby authorizes the settlement of the claim filed by Abdonasser Ashubi in the amount of Eight Hundred Fifty Dollars ($850.00); and be it further
RESOLVED, that the Comptroller is hereby authorized and directed to disburse payment in the amount of $850.00 from Budget Code A1930.494 (Judgments and Settlements) in the 2026 Budget.
