AN ORDINANCE AUTHORIZING CHANGE
ORDER NO. 1 FOR THE EDISON AVENUE PUMP
STATION UPGRADE PROJECT – GENERAL
CONSTRUCTION, CONTRACT NO. 12222024, AND
EXTENDING THE CONTRACT COMPLETION DATE
Whereas, in correspondence dated August 31, 2026, the Commissioner and Deputy Commissioner of the Department of Public Works formally requested authorization for Change Order No. 1 to Contract No. 12222024 – Edison Avenue Pump Station Upgrade Project – General Construction for the purpose of providing for the identification of unknown underground utilities utilizing high-pressure compressed air; and
Whereas, the City of Mount Vernon (“City”), through its Department of Public Works (“Department”), is undertaking the Edison Avenue Pump Station Upgrade Project – General Construction pursuant to Contract No. 12222024; and
Whereas, the Edison Avenue Pump Station collects wastewater from five (5) properties, consisting primarily of industrial businesses, and is a critical component of the City’s sanitary sewer infrastructure; and
Whereas, pursuant to the Consent Decree entered into by and among the City of Mount Vernon, the United States Environmental Protection Agency, the New York State Department of Environmental Conservation (“NYSDEC”), and the United States Department of Justice concerning illicit discharges to the Bronx River and Hutchinson River, in Case No. 7:18-cv-05845-CS, the City is required to undertake improvements to the Edison Avenue Pump Station; and
Whereas, the required upgrades are necessitated, in part, by a history of sanitary sewer overflows from the facility that discharged into the storm sewer system and ultimately into the Hutchinson River; and
Whereas, during the course of construction, the need was identified to locate and identify unknown underground utilities in order to facilitate the safe and proper completion of the Project; and
