Board of Estimate & Contract:
Whereas, on July 29, 2020, S.R., a minor by His Mother and Natural Guardian Melesha Tavares filed a Notice of Claim seeking the sum of $800,000.00 against the City of Mount Vernon for alleging Assault (First); Battery (Second); Negligent Hiring, Retention, Supervision and/or Direction (Third); Negligence (Fourth); Breach of Duty in Loco Parentis (Fifth); Breach of Fiduciary Duty (Sixth); Breach of Non-Delegable Duty (Seventh); and Negligent Infliction of Emotional Distress (Eighth), resulting in the incidents for the period November 1, 2019 and continuing through June/July 2020; and
Whereas, the City of Mount Vernon was served with a Summons and Complaint on January 21, 2022; and
Whereas, by letter dated September 25, 2024, the Corporation Counsel hereby recommends that the Board of Estimate & Contract approve the settlement of the aforesaid claim for $170,000.00; Now, Therefore, be it
Resolved, that the aforesaid claim of S.R., a minor by His Mother and Natural Guardian Melesha Tavares, be settled for the sum of $170,000.00 and that said settlement be and the same hereby is approved; and be it further
Resolved, the sum will be paid out of Budget Code A1930.494 (Judgments & Settlements), 2024 Budget.
