A RESOLUTION AUTHORIZING
THE SETTLEMENT OF THE CLAIM OF
KIMITO HARRIS
WHEREAS, on August 14, 2025, the date of the alleged incident, a Notice of Claim was filed by Kimito Harris against the City of Mount Vernon, alleging that after a member of the Mount Vernon Police Department issued a summons for operating an uninsured motor vehicle, the claimant’s vehicle was required to be towed from the scene; and
WHEREAS, the towing company advised the MVPD that its arrival at the scene would be delayed by more than one hour, and due to the presence of a growing crowd at the location, police officers obtained supervisory approval to relocate the vehicle to Police Headquarters pending the tow company’s arrival; and
WHEREAS, a member of the MVPD drove the claimant’s 2019 Mercedes-Benz to Police Headquarters, and the claimant subsequently alleged that during the relocation of the vehicle, the officer drove over broken glass, causing damage to the underside of the vehicle; and
WHEREAS, the claimant sought reimbursement for the alleged damages in the amount of Two Thousand Nine Hundred Ninety-Three Dollars and Thirty-Two Cents ($2,993.00);
WHEREAS, upon review and evaluation of the claim, the Corporation Counsel, by correspondence dated June 24, 2026, recommended that the Board of Estimate and Contract approve a settlement in the amount of $1,000.00.
NOW, THEREFORE, BE IT
RESOLVED, that the Board of Estimate and Contract hereby authorizes the settlement of the claim filed by Kimito Harris in the amount of $1,000.00; and be it further
RESOLVED, that the Comptroller is hereby authorized and directed to disburse payment in the amount of $1,000.00 from Budget Code A1930.494 (Judgments and Settlements) in the 2026 Budget.
