A RESOLUTION AMENDING RESOLUTION NO. 10,
ADOPTED BY THE BOARD OF ESTIMATE ON
NOVEMBER 13, 2023, SETTLING THE CLAIM OF
JACINTH STEWART-LEWIS AND ELAINE STEELE
The City of Mount Vernon, in City Council convened, does hereby ordain and enact:
Section 1. The first decretal paragraph of Resolution No. 10, adopted by the Board of Estimate on November 13, 2023, settling the claim of Jacinth Stewart-Lewis and Elaine Steele is hereby amended as follows:
Whereas on May 15, 2023, [and October 19, 2023], JACINTH STEWART-LEWIS and ELAINE STEELE (co-owners of the property) filed Notice[s] of Claim[s] seeking the sum of $12,146.00 against the City of Mount Vernon for property damage allegedly caused to the claimants’ premises due to flooding in the basement caused by sewer backup on the premises on April 28, 2023 through April 30, 2023, [and September 29, 2023, (this is why claimants filed a second claim)]; and
Whereas by letter dated November 2, 2023, the Corporation Counsel hereby recommends that the Board of Estimate & Contract approve the settlement of the aforesaid claim in the amount of $10,000.00; NOW, THEREFORE, be it
Resolved that the aforesaid claims of JACINTH STEWART-LEWIS and ELAINE STEELE be settled for the sum of $10,000.00 and that said settlement be and the same hereby is approved; and be it further
Resolved that said sum be paid out of Code A1910.469 (Insurance - Claims), 2023 Budget.
