Board of Estimate and Contract:
A RESOLUTION AUTHORIZING THE
SETTLEMENT OF THE CLAIM OF
LATOYA MOSLEY
WHEREAS, on September 12, 2023, a Notice of Claim was filed by Latoya Mosley against the City of Mount Vernon alleging that her motor vehicle was involved in a collision on August 22, 2023 with a City police vehicle that was responding to an emergency dispatch with its emergency lights and sirens activated at the intersection of East Lincoln Avenue and North Fulton Avenue, and the claimant alleged that she sustained permanent injuries and sought monetary damages initially in the amount of $850,000; and
WHEREAS, the City of Mount Vernon was served with a Summons and Complaint in connection with the claim on February 12, 2024; and
WHEREAS, following review and evaluation of the claim during litigation, the claimant’s demand was subsequently reduced to $550,000 and thereafter further reduced to a settlement demand of $350,000; and
WHEREAS, after additional negotiations between the parties, the claimant agreed to resolve the matter for the total sum of $75,000.00; and
WHEREAS, upon review and evaluation of the claim, the Corporation Counsel, by correspondence dated March 10, 2026, recommended that the Board of Estimate and Contract approve settlement of the matter in the amount of $75,000.00; NOW, THEREFORE, BE IT
RESOLVED, that the Board of Estimate and Contract hereby authorizes the settlement of the claim filed by Latoya Mosley in the amount of $75,000.00; and be it further
RESOLVED, that the Comptroller is hereby authorized and directed to issue payment in the amount of $75,000.00 from Budget Code A1930.494 (Judgments and Settlements) in the 2026 Budget.
