RESOLVED, that an amendment adopted by the City Council on December 27, 2023, and signed by the Mayor on December 28, 2023, amending Ordinance No. 8 adopted by the City Council on May 10, 2023, entitled “AN ORDINANCE REQUESTING PERMISSION FOR THE MAYOR TO ENTER INTO AN AGREEMENT WITH EH US HOUSING AND URBAN DEVELOPMENT (“HUD”) AND ACCEPT A COMMUNITY FUNDING GRANT IN THE AMOUNT OF $1,500,000.00 FOR PROJECTS ENTITLED “OUTFALL 24 - SEWER SYSTEM CLEANING AND INVESTIGATION AND SEWER SYSTEM REHABILITATION - PHASE 1” - (Funds will be deposited into Revenue Code H4097-C936 and H4097C945 {Federal Aid} [H3990.C936 {State Aid}] to be appropriated to budget code H8120.203C936 {Sanitary Sewer Capital} and H8140.203 C945 {Storm Sewer Capital}), be and the same is hereby approved.

ENTITLED “AN ORDINANCE REQUESTING PERMISSION

THE US HOUSING AND URBAN DEVELOPMENT (“HUD”) AND
ACCEPT A COMMUNITY FUNDING GRANT IN THE AMOUNT
OF $1,500,000.00 FOR PROJECTS ENTITLED “OUTFALL
24 - SEWER SYSTEM CLEANING AND INVESTIGATION
AND SEWER SYSTEM REHABILITATION - PHASE 1”
The City of Mount Vernon, in City Council convened, does hereby ordain, and enact:
Section 1. The first decretal paragraph, and Section 2 of Ordinance No. 8, adopted by the City Council on May 10, 2023, entitled “AN ORDINANCE REQUESTING PERMISSION FOR THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE US HOUSING AND URBAN DEVELOPMENT (“HUD”) AND ACCEPT A COMMUNITY FUNDING GRANT IN THE AMOUNT OF $1,500,000.00 FOR PROJECTS ENTITLED “OUTFALL 24 - SEWER SYSTEM CLEANING AND INVESTIGATION AND SEWER SYSTEM REHABILITATION - PHASE 1” is hereby amended as follows:
WHEREAS, by letter dated [May 1, 2023] December 20, 2023, the Commissioner of the Department of Public Works requested legislation to amend Ordinance No. 8, adopted by the City Council on May 10, 2023, authorizing the Mayor to enter into an agreement with the US Housing and Urban Development (“HUD”) to accept a Community Funding Grant, (Agreement # B-22-CP-NY-0662) in the amount of $1,500,000.00 for projects entitled “Outfall 24 Sewer System Cleaning and Investigation and Sewer System Rehabilitation - Phase 1.” The term of the contract shall commence on the date of execution by the Mayor and will remain in effect until August 31, 2030, unless extended by written agreement by either party; NOW, THEREFORE,
The City of Mount Vernon, in City Council convened, does hereby ordain, and enact:
Section 1. The Mayor is hereby authorized to enter into an agreement with the US Housing and Urban Development (HUD) to accept a Community Funding Grant, (Agreement # B-22-CP-NY-0662) in the amount of $1,500,000.00 for projects entitled “Outfall 24 Sewer System Cleaning and Investigation and Sewer System Rehabilitation - Phase 1.” The term of the contract shall commence on the date of execution by the Mayor and will remain in effect until August 31, 2030, unless extended by written agreement by either party.
Section 2. The funds will be deposited into Revenue Codes H4097-C936 and H4097 C945 (Federal Aid) [H3990.C936 (State Aid)] to be appropriated to Budget Code H8120.203.C936 (Sanitary Sewer Capital) and H8140.203 C945 (Storm Sewer Capital) throughout the contract period.
Section 3. This ordinance shall take effect upon its approval by the Board of Estimate & Contract.
