AN ORDINANCE AUTHORIZING FUNDING FOR
THE CITY OF MOUNT VERNON’S 2026 MANDATORY
SEXUAL HARASSMENT PREVENTION AND
WORKPLACE VIOLENCE PREVENTION TRAINING
Whereas, the City of Mount Vernon (“City”) is required to provide annual sexual harassment prevention training and workplace violence prevention training to its employees in accordance with applicable New York State laws and regulations; and
Whereas, the City is committed to maintaining a safe, respectful, and professional workplace and to ensuring that all City employees receive the training required to satisfy the City's annual legal and workplace safety obligations; and
Whereas, the City proposes to provide the required 2026 Sexual Harassment Prevention and Workplace Violence Prevention Training virtually through the City’s Employee Assistance Program (“EAP”) vendor; and
Whereas, the training will consist of five (5) virtual sessions to provide all City employees with an opportunity to complete the required training during the 2026 training cycle; and
Whereas, the total cost for the provision of the five (5) training sessions is One Thousand Two Hundred Dollars ($1,200.00); and
Whereas, as part of the City's austerity measures, funding for this mandatory training was removed from the Human Resources Education and Training budget; and
Whereas, notwithstanding such austerity measures, funding is necessary to ensure that the City fulfills its mandatory annual training obligations and remains in compliance with applicable New York State requirements; and
Whereas, the Board of Estimate has been requested to authorize the expenditure of $1,200.00 from the Board of Estimate Training Line, Account A1030.402, for the 2026 mandatory training; and
Whereas, the Board of Estimate has determined that the expenditure is necessary and appropriate to fulfill the City's legal obligations and promote a safe and respectful workplace;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOUNT VERNON, NEW YORK, AS FOLLOWS:
Section 1. Authorization of Funding. The City of Mount Vernon is hereby authorized to expend an amount not to exceed One Thousand Two Hundred Dollars ($1,200.00) for the City's 2026 Mandatory Sexual Harassment Prevention and Workplace Violence Prevention Training.
Section 2. Training Services. The authorized funding shall be used for the provision of five (5) virtual training sessions by the City’s Employee Assistance Program ("EAP") vendor for the purpose of providing City employees with the required annual Sexual Harassment Prevention and Workplace Violence Prevention Training.
Section 3. Source of Funds. The expenditure authorized herein shall be charged to the Board of Estimate Training Line, Account A1030.402, in an amount not to exceed $1,200.00, subject to the availability of appropriated funds.
Section 4. Compliance with Mandatory Training Requirements. The City's Human Resources Department and appropriate administrative personnel are authorized and directed to coordinate the training sessions and take all necessary administrative actions to ensure that City employees are afforded the opportunity to complete the required 2026 training.
Section 5. Fiscal Responsibility. The expenditure authorized by this Ordinance is intended to satisfy mandatory training requirements while recognizing the City's current austerity measures and should be limited to the amount necessary to obtain the required training services.
Section 6. Authorization to Execute Documents. The Mayor, Comptroller, Commissioner of Human Resources, and other appropriate City officials are hereby authorized to execute any documents and take any actions necessary or appropriate to implement the purposes and provisions of this Ordinance, subject to review and approval by the Corporation Counsel as to form and legal sufficiency.
Section 7. Severability. If any provision of this Ordinance is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such determination shall not affect the validity, legality, or enforceability of the remaining provisions of this Ordinance.
Section 8. Effective Date. This Ordinance shall take effect immediately upon its adoption by the City Council, subject to prior approval by the Board of Estimate and Contract.
Board of Estimate and Contract:

WHEREAS, the Department of Human Resources has arranged for the required 2026 Mandatory Sexual Harassment Prevention and Workplace Violence Prevention Training to be provided virtually to City employees; and
WHEREAS, payment is required for the services provided in accordance with the attached invoice; and
WHEREAS, the total cost of the training is $1,200.00, to be charged to A1030.402;
NOW, THEREFORE, BE IT RESOLVED, that the appropriate City officials are hereby authorized to approve and process payment of the attached invoice in the amount of $1,200.00 for the 2026 Mandatory Sexual Harassment Prevention and Workplace Violence Prevention Training, to be virtually provided through the Department of Human Resources, with said expense charged to A1030.402
