The City of Mount Vernon, in City Council convened, does hereby ordain, and enact:

Whereas, by correspondence dated June 1, 2026, the Commissioner and Deputy Commissioner of the Department of Public Works requested authorization to amend Ordinance No. 3, adopted by the City Council on May 27, 2026, entitled “AN ORDINANCE AUTHORIZING THE ADVERTISEMENT AND SOLICITATION OF BIDS FOR IFB NO. 4.26 - CITY OF MOUNT VERNON FIRE STATION APRON REHABILITATION (STATIONS 2 & #); and

Whereas, on May 27, 2026, the City Council of the City of Mount Vernon authorized an Emergency Declaration concerning deteriorated conditions at Fire Department of Mount Vernon (“FDMV”) Station 2 and FDMV Station 3; and

Whereas, the Department of Public Works has determined that an amendment to the Emergency Declaration is necessary to further clarify the procedures governing emergency repair and remediation work and to ensure compliance with applicable City procurement policies and requirements; and

Whereas, two separate incidents associated with deteriorated conditions at the affected facilities have resulted in staff injuries, reducing the number of available emergency responders and adversely impacting the operational capacity of the Fire Department; and

Whereas, the Commissioner of the Department of Public Works and the Chief of Infrastructure have determined that the deteriorated concrete apparatus aprons located at FDMV Station 2 and FDMV Station 3 constitute an immediate threat to the health, safety, and welfare of City personnel and the public; and

Whereas, the condition of the apparatus aprons has significantly worsened due to unusually severe winter weather conditions, including prolonged periods of cold temperatures, precipitation, and freeze-thaw cycles, resulting in accelerated deterioration of the concrete surfaces; and

Whereas, the affected City-owned facilities are located at:

1.                     Fire Department Station 2, 435 South Fulton Avenue, Mount Vernon, New York 10553; and

2.                     Fire Department Station 3, 50 West 3rd Street, Mount Vernon, New York 10550; and

Whereas, the City Council finds that the continued deterioration of the apparatus aprons presents a substantial risk of injury to emergency personnel, damage to emergency response equipment, interruption of fire protection services, and impairment of the City's ability to provide critical emergency response functions; and

Whereas, the City Council further finds that immediate repair and rehabilitation of the apparatus aprons is necessary to preserve public safety, protect municipal assets, and ensure the uninterrupted operation of the City's fire service facilities; and

Whereas, funding for the emergency rehabilitation project is available through funds provided by the Urban Renewal Agency (“URA”); and

Whereas, the City Council finds that authorizing the receipt and use of URA funds for this project serves a valid municipal purpose and is in the best interests of the residents of the City of Mount Vernon.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOUNT VERNON AS FOLLOWS:

Section 1.                     Amendment to Emergency Declaration.  The City Council hereby approves and ratifies the Amendment to the Emergency Declaration previously authorized on May 27, 2026, relating to the rehabilitation and repair of the deteriorated apparatus aprons at Fire Department Station 2 and Fire Department Station 3.
