RESOLVED, that an ordinance adopted by the City Council on May 8, 2024, and signed by the Mayor on May 9, 2024, authorizing the Initiation of Procurement for ADA-Accessible Elevator Lift System at Memorial Field - ($540,000.00, funding secured from the Community Development Block Grant (CDBG) program), be and the same is hereby approved.

OF Procurement for ADA-Accessible
Elevator Lift System at Memorial Field
Whereas, by letter dated May 2, 2024, the Commissioner of the Department of Public Works has requested legislation authorizing the Department to initiate the procurement process for the design and construction of an ADA-accessible Elevator Lift System at Memorial Field; and
Whereas, the City of Mount Vernon is committed to ensuring equal access for all individuals, including those with disabilities, in compliance with the Americans with Disabilities Act (ADA); and
Whereas, Memorial Field Stadium requires an ADA-accessible Elevator Lift System to facilitate essential access for staff and individuals with disabilities to the Press Box area; and
Whereas, the implementation of ADA-compliant access at Memorial Field Stadium aligns with the city's values of inclusivity and fulfills legal obligations concerning accessibility standards; and
Whereas, the initiation of the procurement process for the design and construction of an ADA-accessible Elevator Lift System at Memorial Field will mitigate the city’s exposure to potential litigation related to ADA non-compliance; and
Whereas, the Department of Public Works has requested authorization to issue a Request for Proposal (RFP) to solicit bids for the design and construction of the ADA-accessible Elevator Lift System; and
Whereas, the budget allocated for this project is $540,000.00, with funding secured from the Community Development Block Grant (CDBG) program; and
Whereas, it is imperative to expedite this process to ensure that the City of Mount Vernon meets ADA requirements and provides equitable access to all individuals; Now, Therefore, Be It Resolved That
The City of Mount Vernon, in City Council convened, does hereby ordain, and enact:
Section 1. Authorization to Initiate Procurement Process. The City of Mount Vernon hereby authorizes the Department of Public Works to initiate the procurement process for the design and construction of an ADA-accessible Elevator Lift System at Memorial Field Stadium.
Section 2. Issuance of Request for Proposal (RFP). The Department of Public Works is authorized to issue a Request for Proposal (RFP) to solicit bids from qualified contractors for the design and construction of the ADA-accessible Elevator Lift System.
Section 3. Budget Allocation. The budget allocated for the design and construction of the ADA-accessible Elevator Lift System at Memorial Field Stadium is $540,000.00.
Section 4. Funding Source. Funding for this project shall be secured from the Community Development Block Grant (CDBG) program.
Section 5. Expedited Process. It is mandated that the procurement process for the ADA-accessible Elevator Lift System at Memorial Field Stadium be expedited to ensure timely compliance with ADA requirements.
Section 6. Effective Date. This ordinance shall take effect upon its approval by the Board of Estimate & Contract.
