RESOLVED, that a resolution adopted by the City Council on October 23, 2024, and signed by the Mayor on October 24, 2024, authorizing the Mayor to Accept Funding from the Urban Renewal Agency (URA) in the Community Development Block Grant Funds and Authorizing the Department of Public Works to Purchase and Install a Prefabricated Restroom and Storage Structure at Memorial Field Stadium, as follows:

AN ORDINANCE AUTHORIZING THE MAYOR TO
ACCEPT FUNDING FROM THE URBAN RENEWAL
AGENCY (URA) IN THE COMMUNITY DEVELOPMENT
BLOCK GRANT FUNDS AND AUTHORIZING THE
DEPARTMENT OF PUBLIC WORKS TO PURCHASE
AND INSTALL A PREFABRICATED RESTROOM AND
STORAGE STRUCTURE AT MEMORIAL FIELD STADIUM
Whereas, by letter dated October 3, 2024, the Commissioner of the Department of Public Works has requested legislation authorizing the Mayor to receive an award in the amount of $550,000.00 from the Urban Renewal Agency (URA) in Community Development Block Grant funds to cover the cost and fully install a prefabricated restroom and storage structure adjacent to the tennis courts at Memorial Field Stadium. The total project cost shall not exceed $550,000.00; and
Whereas, the Department of Public Works has identified a critical need for a restroom and storage facility adjacent to the tennis courts at Memorial Field Stadium to provide convenient, ADA-compliant restroom facilities for visitors, especially for those with mobility challenges; and
Whereas, the current restroom facilities are located over 100 yards away from the tennis courts, on the opposite side of the stadium, and are often inaccessible when the stadium is closed; and
Whereas, the Recreation Department has secured $550,000.00 in funding from the Urban Renewal Agency (URA) in Community Development Block Grant (CDBG) funds to cover the cost of this project fully; and
Whereas, the Department of Public Works has sourced a prefabricated restroom and storage structure from the Public Restroom Company through Sourcewell and intends to purchase and install the structure to enhance the quality of amenities provided to the public; and
Whereas, the structure will include restroom facilities compliant with the Americans with Disabilities Act (ADA) and essential storage space for sports equipment, providing dual functionality and addressing the community’s need for secure, convenient storage on-site; Now, Therefore, Be It Resolved That
The City of Mount Vernon, in City Council convened, does hereby ordain and enact:
Section 1. Definitions:
• “ADA Compliance” refers to adhering to the Americans with Disabilities Act, which ensures that public facilities are accessible to individuals with disabilities.
• “Community Development Block Grant (CDBG)” Federal funds provided by the Department of Housing and Urban Development (HUD) aimed at community development, particularly for low- and moderate-income areas.
• “Prefabricated Restroom and Storage Structure” is a factory-built facility delivered to the project site, including public restrooms and storage space.
• “Turnkey Installation” is a comprehensive installation service that includes all aspects required to install and operationalize a facility fully.
• “Urban Renewal Agency (URA” An agency that administers community development funds and initiatives to improve infrastructure, facilities, and public spaces.
Section 2. Authorization to Received Award and Purchase and Install. The City Council hereby authorizes the Mayor to receive an award in the amount of $550,000.00 from the Urban Renewal Agency (URA) in Community Development Block Grant funds to cover the cost and fully install a prefabricated restroom and storage structure adjacent to the tennis courts at Memorial Field Stadium, which includes the following expenditures:
1. Prefabricated Restroom Building - $389,895.00
2. Turnkey Installation of the Building - $ 39,633.00
3. Subgrade Pad (Foundation) - $120,000.00
The exact allocation for the subgrade pad will be finalized upon completion of the design phase and the contractor bidding process.
Section 3. Funding. The City of Mount Vernon shall accept a $550,000.00 award from the Community Development Block Grant funds through the Urban Renewal Agency to fully cover the costs of this project.
No additional funds from the city’s general budget will be required for this project, as the CDBG award will cover the entire expenditure.
Section 4. Procurement Process. The Department of Public Works shall utilize Sourcewell procurement to purchase the prefabricated restroom and storage structure, as Sourcewell contracts meet competitive bidding requirements and provide access to high-quality vendors such as the Public Restroom Company.
Section 5. Project Implementation and Oversight. The Department of Public Works oversees the implementation and installation of the restroom and storage structure. This includes coordinating with contractors, ensuring compliance with ADA requirements, and completing all necessary site preparations.
Section 6. Effective Date. This ordinance shall take effect immediately upon its approval by the Board of Estimate & Contract.
