RESOLVED, that an Ordinance adopted by the City Council on May 13, 2026, and signed by the Mayor on May 15, 2026, authorizing the Office of the City Comptroller to establish a Custodial Account for the Development Project Located at 230 West Third Street, Mount Vernon, New York, as follows:
Purpose of Account. The custodial account established pursuant to this Ordinance shall be utilized for costs and expenses related to the development review process, including but not limited to:
1. Reimbursement of attorney fees and professional consultant expenses incurred by the City;
2. Administrative and processing costs associated with project review;
3. Fees related to applications, submissions, and presentations before the City Council and applicable boards; and
4. Any other lawful expenditures associated with the proposed development project.

AN ORDINANCE AUTHORIZING THE
OFFICE OF THE CITY COMPTROLLER TO
ESTABLISH A CUSTODIAL ACCOUNT FOR THE

WEST THIRD STREET, MOUNT VERNON, NEW YORK
Whereas, in correspondence dated May 12, 2026, the Legislative Assistant to the Mount Vernon City Council formally requested authorization the Office of the City Comptroller to establish a custodial account the development project located at 230 West Third Street, Mount Vernon, New York 10550, for the purpose of receiving, holding, managing, and disbursing funds associated with the review and administration of the proposed project; and
Whereas, in correspondence submitted to the City Council, a request was made for authorization permitting the Office of the City Comptroller to establish a custodial account for the development project located at 230 West Third Street, Mount Vernon, New York 10550; and
Whereas, the proposed development project involves the construction and operation of a self-storage facility; and
Whereas, the custodial account shall serve as a temporary holding account for funds associated with the review, administration, and processing of the proposed development project; and
Whereas, the custodial account shall be utilized to receive, hold, manage, and disburse funds related to required project submissions, presentations before the City Council, application processing, and reimbursement of attorney fees and other professional expenses incurred by the City in connection with the development review process; and

Whereas, the City Council finds that the establishment of such a custodial account is necessary and proper to ensure the orderly administration of development-related funds, compliance with municipal requirements, and the efficient processing of the proposed project.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOUNT VERNON, NEW YORK, AS FOLLOWS:
Section 1. Authorization to Establish Custodial Account. The Office of the City Comptroller is hereby authorized and directed to establish a custodial account for the development project located at 230 West Third Street, Mount Vernon, New York 10550, for the purpose of receiving, holding, managing, and disbursing funds associated with the review and administration of the proposed project.
Section 2. Purpose of Account. The custodial account established pursuant to this Ordinance shall be utilized for costs and expenses related to the development review process, including but not limited to:

6. Administrative and processing costs associated with project review;
7. Fees related to applications, submissions, and presentations before the City Council and applicable boards; and
8. Any other lawful expenditures associated with the proposed development project.
Section 3. Conditions of Use. The custodial account shall remain subject to all applicable laws, rules, regulations, and procedures of the City of Mount Vernon. No funds shall be disbursed except in accordance with the policies and procedures established by the Office of the City Comptroller and applicable municipal requirements.
Section 4. Authorization of City Officials. The Mayor, City Comptroller, Corporation Counsel, and any other appropriate City officials are hereby authorized to take all actions and execute any documents necessary to effectuate the purposes of this Ordinance.
Section 5. Severability. If any clause, sentence, paragraph, subdivision, section, or part of this Ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part thereof directly involved in the controversy in which such judgment shall have been rendered.
Section 6. Effective Date. This Ordinance shall take effect immediately upon adoption by the City Council and subsequent approval by the Board of Estimate and Contract.
