A RESOLUTION AUTHORIZING THE
SETTLEMENT OF THE CLAIM OF
ARTYA GREEN
WHEREAS, on October 26, 2023, the City of Mount Vernon (the “City”) was served with a Summons and Complaint in an action commenced by Artya Green, alleging that she fell into an open manhole in the street and sustained injuries to her back, left hip, and left knee; and
WHEREAS, the Summons and Complaint sought damages in the amount of One Hundred Thousand Dollars ($100,000.00) against the City; and
WHEREAS, the matter is being resolved through a global settlement in the total amount of Twenty-Seven Thousand Dollars ($27,000.00), pursuant to which the plaintiff has agreed to withdraw all claims against the City and the four additional defendants, with each of the other defendants contributing Six Thousand Dollars ($6,000.00) and the City contributing Three Thousand Dollars ($3,000.00) toward the settlement; and
WHEREAS, by letter dated October 27, 2026, the Corporation Counsel recommended that the Board of Estimate and Contract approve the settlement of the aforesaid claim for the City's contribution of Three Thousand Dollars ($3,000.00); and
WHEREAS, the Board of Estimate and Contract has considered the recommendation of the Corporation Counsel and finds that settlement of this matter in the recommended amount is in the best interests of the City; now, therefore, be it
RESOLVED, that the settlement of the claim entitled Artya Green v. Hutchinson, et al., and the City of Mount Vernon, for the City’s contribution of Three Thousand Dollars ($3,000.00), as part of the global settlement in the total amount of Twenty-Seven Thousand Dollars ($27,000.00), be and hereby is approved; and be it further
RESOLVED, that the Comptroller of the City of Mount Vernon be and hereby is authorized and directed to issue payment in the amount of Three Thousand Dollars ($3,000.00) in full settlement of the City’s liability in connection with the aforesaid claim, subject to receipt of all required settlement documentation, releases, and any other documents deemed necessary by the Corporation Counsel; and be it further
RESOLVED, that the aforesaid payment shall be charged to Budget Code A1930.494 - Judgments & Settlements, 2026 Budget.
