RESOLVED, that a resolution adopted by the City Council on October 23, 2024, and signed by the Mayor on October 24, 2024, authorizing the Mayor to Retroactively Enter into an Emergency Contractual Agreement with PCI Industries, Inc. for the Repair of Stormwater and Sanitary Sewer Systems at the Intersection of 13th Avenue and 3rd Street - ($101,714.49, and funding is available through the WQIP Emergency Grant under Budget Codes H8120.203.C937 (Sanitary Sewer), and H8140.203.C938 (Stormwater) be, and the same is hereby approved.

AN ORDINANCE AUTHORIZING THE MAYOR
TO RETROACTIVELY ENTER INTO AN EMERGENCY
CONTRACTUAL AGREEMENT WITH PCI INDUSTRIES,
INC. FOR THE REPAIR OF STORMWATER AND
SANITARY SEWER SYSTEMS AT THE
INTERSECTION OF 13TH AVENUE AND 3RD STREET
Whereas, by letter dated October 11, 2024, the Commissioner of the Department of Public Works has requested legislation authorizing the Mayor to retroactively enter into an emergency contractual agreement with PCI Industries, Inc. to remove, replace, and rehabilitate stormwater and sanitary sewer systems at the intersection of 13th Avenue and 3rd Street; and
Whereas, the City of Mount Vernon experienced a health hazard at the intersection of 13th Avenue and 3rd Street due to backups in the stormwater sewer system during rain events, causing flooding at the intersection and nearby properties; and
Whereas, the flooding was caused by compromised catch basins at three of the four corners of the intersection, necessitating immediate action to prevent further health risks and damage to public and private property; and
Whereas, PCI Industries, Inc. was contracted on an emergency basis to remove blockages, rebuild catch basins, and replace stormwater sewer pipes to prevent further flooding and ensure public safety; and
Whereas, the City of Mount Vernon Procurement Policy allows for emergency purchases where immediate action is required to protect public property, life, safety, health, or welfare, or to maintain essential services without seeking alternate proposals; and
Whereas, the total cost for the completed emergency repair work is $101,714.49, and funding is available through the WQIP Emergency Grant under Budget Codes H8120.203.C937 (Sanitary Sewer), and H8140.203.C938 (Stormwater); Now, Therefore, Be It Resolved That
The City of Mount Vernon, in City Council convened, does hereby ordain and enact:
Section 1. Authorization to Enter into Agreement. The Mayor is hereby authorized to retroactively enter into an emergency contractual agreement with PCI Industries, Inc. to remove, replace, and rehabilitate stormwater and sanitary sewer systems at the intersection of 13th Avenue and 3rd Street.
Section 2. Scope of Work. The scope of work completed by PCI Industries, Inc. is as follows:
• Location: Intersection of 13th Avenue and West 13th Street
• Southwest, Northwest, and Southeast catch basins had to be rebuilt with new stormwater-collecting sewers
Damage:
• Southwest - two catch basins and stormwater sewer piping.
• Northwest - three catch basins and stormwater sewer piping.
• Southeast - one catch basin.
Repairs Completed:
• Southwest - built one catch basin, rebuilt one catch basin, and Installed 15 feet of SDR stormwater sewer pipe. Excavated and repoured sidewalk corner.
• Northwest - rebuilt two catch basins and installed 35 linear feet of SDR stormwater sewer pipe. Excavated and repoured sidewalk corner.
• Southeast - rebuilt one catch basin, excavated and repoured
Section 3. Funding. The total cost for the emergency repairs of $101,714.49 shall be funded through the following budget codes:
• H8120.203.C937 (Sanitary Sewer)
• H8140.203.C938 (Stormwater)
Section 4. Emergency Procurement Policy. This emergency contract is authorized in accordance with the City of Mount Vernon's procurement policy, Section 6, which allows for emergency purchases to address immediate threats to public health, safety, and property.
Section 5. Effective Date. This ordinance shall take effect immediately upon its approval by the Board of Estimate & Contract.
