AN ORDINANCE AMENDING ORDINANCE NO. 2,
ADOPTED BY THE CITY COUNCIL ON AUGUST 19,
2022, ENTITLED “AN ORDINANCE AUTHORIZING
THE MAYOR TO ENTER INTO AN AGREEMENT
WITH THE NEW YORK STATE ENVIRONMENTAL
FACILITIES CORPORATION (“NYS EFC”) TO ACCEPT
GRANT FUNDS FOR CAPITAL IMPROVEMENT
PROJECTS THROUGHOUT THE CITY”
The City of Mount Vernon, in City Council convened, does hereby ordain and enact:
Section 1. The first decretal paragraph and Section 2 of Ordinance No. 2, adopted on August 19, 2022, entitled “AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE NEW YORK STATE ENVIRONMENTAL FACILITIES CORPORATION (“NYS EFC”) TO ACCEPT GRANT FUNDS FOR CAPITAL IMPROVEMENT PROJECTS THROUGHOUT THE CITY” is hereby amended as follows:
WHEREAS, by letter dated [August 9, 2022] February 5, 2024, the Commissioner of the Department of Public Works requested legislation authorizing the Mayor to enter into an agreement with the New York State Environmental Facilities Corporation (“NYS EFC”) to accept grant funding in the aggregate amount of $5,000,000.00 to fund Capital Improvement Projects throughout the City as identified in the June 2022 Illicit Discharge Plan (“IDAP”); and
WHEREAS, the contract shall being on the date of execution by the Mayor and remain in effect until March 31, 2027, unless extended by written agreement by the parties; NOW, THEREFORE,
The City of Mount Vernon, in City Council convened, does hereby ordain and enact:
Section 1. The Mayor is hereby authorized to enter into an agreement with the New York State Environmental Facilities Corporation (“NYS EFC”) to accept grant funding in an aggregate amount of $5,000,000.00 to fund Capital Improvement Projects throughout the City as identified in the June 2022 Illicit Discharge Plan (“IDAP”).
Section 2. The funds will be deposited into Revenue Code H3990 (State Aid, Sewer Cap Pro) [to be appropriated to] and accounted for in the following capital fund accounts:
• H8120.203 C934: Sanitary Sewer in the amount of $4,000,000.00; and
• H8140.203 C935: Storm Sewer in the amount of $1,000,000.00.
[Budget Code A8120.405 (DPW Sanitary and Storm Sewers; Outside Contracted Services) throughout the contract period].
Section 3. This ordinance shall take effect upon its approval by the Board of Estimate & Contract.
