AN ORDINANCE TO AMEND ORDINANCE NO. 21,
ADOPTED BY THE CITY COUNCIL ON AUGUST 12,
2026, AND FURTHER AMEND CHAPTER 238 OF THE
CODE OF THE CITY OF MOUNT VERNON, ENTITLED
“TAXICAB COMMISSION,” TO REPLACE THE
DIRECTOR OF WEIGHTS AND MEASURES WITH
THE ORDINANCE OFFICER AS AN EX OFFICIO
MEMBER OF THE TAXICAB COMMISSION
Whereas, the City Council of the City of Mount Vernon previously adopted Ordinance No. 21 on August 12, 2026, amending the provisions of Chapter 238 of the Code of the City of Mount Vernon concerning the membership and composition of the Taxicab Commission; and
Whereas, the City Council has determined that a further amendment to Chapter 238 is appropriate to modernize the composition of the Taxicab Commission and better align its membership with the City’s current administrative, regulatory, enforcement, and compliance functions; and
Whereas, the current inclusion of the Director of Weights and Measures as an ex officio member of the Taxicab Commission appears to reflect an earlier regulatory structure in which the duties and responsibilities of that office were more directly associated with oversight of the taxicab industry; and
Whereas, as City operations, technology, and regulatory responsibilities have evolved, the present responsibilities of the Director of Weights and Measures have become less directly connected to the day-to-day regulatory, enforcement, licensing, and compliance matters considered by the Taxicab Commission; and
Whereas, the duties and responsibilities of the Ordinance Officer are more closely aligned with the current responsibilities of the Taxicab Commission, including monitoring and enforcing compliance with applicable City codes, ordinances, rules, regulations, licensing requirements, and other municipal standards; and
Whereas, the appointment of the Ordinance Officer as an ex officio member of the Taxicab Commission will provide the Commission with direct access to an enforcement-oriented municipal official whose regular responsibilities correspond more closely with the regulatory matters the Commission is charged with reviewing and addressing; and
Whereas, replacing the Director of Weights and Measures with the Ordinance Officer will modernize the composition of the Taxicab Commission, improve coordination among City departments and personnel, and promote more effective administration and enforcement of the laws, rules, and regulations governing the taxicab industry within the City of Mount Vernon; and
Whereas, the City Council finds that the proposed amendment is in the best interests of the City and its residents and will further the efficient and effective operation of the Taxicab Commission; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOUNT VERNON, NEW YORK, AS FOLLOWS:
Section 1. Amendment to Ordinance No. 21. Ordinance No. 21, adopted by the City Council of the City of Mount Vernon on August 12, 2026, is hereby amended to the extent necessary to effectuate the changes set forth herein.
Section 2. Amendment to Chapter 238 - Taxicab Commission. Chapter 238 of the Code of the City of Mount Vernon, entitled “Taxicab Commission,” is hereby further amended to replace the Director of Weights and Measures as an ex officio member of the Taxicab Commission with the Ordinance Officer.
Accordingly, wherever Chapter 238 provides that the Director of Weights and Measures shall serve as an ex officio member of the Taxicab Commission, such provision shall be amended to provide that the Ordinance Officer shall serve as an ex officio member of the Taxicab Commission.
Section 3. Duties and Status of Ex Officio Member. The Ordinance Officer shall serve as an ex officio member of the Taxicab Commission and shall perform such duties and responsibilities as are authorized by Chapter 238, the Code of the City of Mount Vernon, and applicable law.
The Ordinance Officer shall assist the Taxicab Commission, as appropriate, with matters relating to compliance, enforcement, licensing, regulations, and other municipal requirements applicable to the taxicab industry.
Section 4. No Change to Other Provisions. Except as expressly amended herein, all other provisions of Ordinance No. 21, adopted August 12, 2026, and Chapter 238 of the Code of the City of Mount Vernon shall remain unchanged and in full force and effect.
Section 5. Severability. If any clause, sentence, paragraph, subdivision, section, or part of this Ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such adjudication shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part thereof directly involved in the controversy in which such judgment shall have been rendered.
Section 6. Effective Date. This Ordinance shall take effect immediately upon adoption and shall be filed and incorporated into the Code of the City of Mount Vernon as required by law.
Section 7. Repealer. All ordinances, local laws, resolutions, or parts thereof inconsistent with the provisions of this Ordinance are hereby repealed to the extent of such inconsistency.
