RESOLVED, that an ordinance adopted by the City Council on October 23, 2024, and signed by the Mayor on October 24, 2024, authorizing the Mayor to Renew a Contract Agreement with the New York State Department of Agriculture and Markets for Fuel Inspection Services - (the City shall be reimbursed for up to $11,550.00 by the New York State Department of Agriculture and Markets for costs incurred in performing fuel inspection services.  All reimbursements will be deposited into Revenue Code A3389.9 (NYS Other), be and the same is hereby approved.

AN ORDINANCE AUTHORIZING THE MAYOR

TO RENEW A CONTRACT AGREEMENT WITH THE

NEW YORK STATE DEPARTMENT OF AGRICULTURE

AND MARKETS FOR FUEL INSPECTION SERVICES

 

Whereas, by letter dated October 15, 2024, the Commissioner of the Department of Public Safety has requested legislation authorizing the Mayor to renew the contract agreement with the New York State Department of Agriculture and Markets, covering the period from April 1, 2024, to March 31, 2029, to conduct fuel inspections, screening tests, and fuel sampling at retail fuel outlets within the City of Mount Vernon; and

Whereas, the City of Mount Vernon, through its Consumer Protection Department, is responsible for conducting inspections, screening tests, and fuel sampling at retail fuel outlets to ensure compliance with New York State standards; and

Whereas, the City has a contractual agreement with the New York State Department of Agriculture and Markets, which allows the City to perform these services and receive reimbursement for the costs incurred; and

Whereas, the City will be reimbursed up to $11,550.00 by the New York State Department of Agriculture and Markets for the services rendered during the contract period from April 1, 2024, to March 31, 2029; and

Whereas, funds reimbursed to the City will be deposited into revenue line A3389.9 (NYS Other) and appropriated to corresponding expenditure lines, ensuring the continued support of the Consumer Protection Department’s fuel inspection efforts, Now, Therefore, Be It Resolved That

The City of Mount Vernon, in City Council convened, does hereby ordain and enact:

Section 1.                     Authorization to Renew Contract.  The Mayor is hereby authorized to renew the contract agreement with the New York State Department of Agriculture and Markets, covering the period from April 1, 2024, to March 31, 2029, to conduct fuel inspections, screening tests, and fuel sampling at retail fuel outlets within the City of Mount Vernon.

Section 2.                     Reimbursement.  The City shall be reimbursed for up to $11,550.00 by the New York State Department of Agriculture and Markets for costs incurred in performing fuel inspection services.  All reimbursements will be deposited into Revenue Code A3389.9 (NYS Other).

Section 3.                     Funding Appropriation.  Reimbursed funds shall be appropriated to the corresponding expenditure lines as required to cover the costs of fuel inspections, screening tests, and sampling.

Section 4.                     Effective Date.  This ordinance shall take effect immediately upon its approval by the Board of Estimate & Contract.
