RESOLVED, that an Ordinance adopted by the City Council on June 24, 2026, and signed by the Mayor on June 25, 2026, authorizing the Mayor to Execute an Intergovernmental Agreement with the New York State Office of Information Technology Services and the New York State Division of Homeland Security for and Emergency Services for Participation in Phase II of the Endpoint Detection and Response (EDR) Program at no Cost to the City - (no appropriation of City funds shall be required for the licensing costs associated with the EDR Program. All software licensing costs, estimated at Seventy-Nine Thousand Two Hundred Eighty-Five Dollars and Fifty Cents ($79,285.50) over the term of the agreement, shall be paid by New York State; fully reimbursable through grant funding and does not require any matching contribution from the City); be, and the same is hereby approved.

AN ORDINANCE AUTHORIZING THE MAYOR
TO EXECUTE AN INTERGOVERNMENTAL
AGREEMENT WITH THE NEW YORK STATE
OFFICE OF INFORMATION TECHNOLOGY
SERVICES AND THE NEW YORK STATE
DIVISION OF HOMELAND SECURITY AND
EMERGENCY SERVICES FOR PARTICIPATION
IN PHASE II OF THE ENDPOINT DETECTION AND
RESPONSE (EDR) PROGRAM AT NO COST TO THE CITY
Whereas, in correspondence dated June 16, 2026, the Commissioner of the Department of Management Services formally requested authorization for the Mayor to execute, on behalf of the City of Mount Vernon, an Intergovernmental Agreement with the New York State Office of Information Technology Services and the New York State Division of Homeland Security and Emergency Services for participation in Phase II of the Endpoint Detection and Response Program, together with such amendments, renewals, certifications, and related documents as may be necessary to effectuate the purposes of this Ordinance; and
Whereas, the Department of Management Services has requested authorization for the Mayor to execute an Intergovernmental Agreement (“IGA”) between the City of Mount Vernon, the New York State Office of Information Technology Services (“ITS”), and the New York State Division of Homeland Security and Emergency Services (“DHSES”) for participation in Phase II of the State’s Endpoint Detection and Response (“EDR”) Program; and
Whereas, the EDR Program provides advanced cybersecurity protection for municipal computers, servers, laptops, and other network-connected devices by continuously monitoring for malicious activity, including ransomware attacks, unauthorized access attempts, malware infections, and other cyber threats; and
Whereas, Phase II of the EDR Program expands the cybersecurity protections previously provided under Phase I by increasing endpoint coverage throughout the City’s information technology environment and enhancing coordination with the New York State Security Operations Center (“NYSOC”) for more rapid detection, analysis, and response to cybersecurity incidents; and
Whereas, pursuant to the proposed IGA, New York State will procure and provide CrowdStrike Endpoint Detection and Response software licenses on behalf of the City and will assume all costs associated with such licenses for the duration of the agreement; and
Whereas, the City’s obligations under the IGA are limited to assigning a technical lead to assist with deployment and implementation activities, maintaining software updates, and sharing cybersecurity alerts from City endpoints with the State Security Operations Center to facilitate statewide threat monitoring and response efforts; and
Whereas, approximately four hundred fifty (450) City endpoints will receive cybersecurity protection under the program; and
Whereas, the term of the proposed agreement shall be three (3) years from the effective date thereof, with either party retaining the right to terminate the agreement upon ninety (90) days’ prior written notice; and
Whereas, the estimated value of the CrowdStrike EDR licenses to be provided to the City under the agreement is Seventy-Nine Thousand Two Hundred Eighty-Five Dollars and Fifty Cents ($79,285.50) over the three-year term; and
Whereas, no City funds are required for participation in the program, as all licensing costs shall be paid by New York State; and
Whereas, cybersecurity threats directed at local governments continue to increase in frequency and sophistication, and participation in the State-funded EDR Program will materially strengthen the City’s ability to prevent, detect, and respond to cyber incidents without additional cost to taxpayers; and
Whereas, the proposed Intergovernmental Agreement has been reviewed by the Department of Management Services and the Law Department as part of the City’s standard contract review process; and
Whereas, the City Council finds that participation in the EDR Program is in the best interests of the City of Mount Vernon and its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOUNT VERNON, NEW YORK, AS FOLLOWS:
Section 1. Authorization to Execute Agreement. The Mayor is hereby authorized and directed to execute, on behalf of the City of Mount Vernon, an Intergovernmental Agreement with the New York State Office of Information Technology Services and the New York State Division of Homeland Security and Emergency Services for participation in Phase II of the Endpoint Detection and Response Program, together with such amendments, renewals, certifications, and related documents as may be necessary to effectuate the purposes of this Ordinance.
Section 2. Acceptance of State-Funded Cybersecurity Services. The City hereby accepts participation in the New York State Security Operations Center Endpoint Detection and Response Program and the associated CrowdStrike endpoint protection services to be provided for approximately four hundred fifty (450) City endpoints at no cost to the City.
Section 3. No City Funding Required. No appropriation of City funds shall be required for the licensing costs associated with the EDR Program. All software licensing costs, estimated at Seventy-Nine Thousand Two Hundred Eighty-Five Dollars and Fifty Cents ($79,285.50) over the term of the agreement, shall be paid by New York State.
Section 4. Implementation. The Department of Management Services and all other appropriate City officials are authorized and directed to take all actions necessary to implement the provisions of this Ordinance and to ensure compliance with the requirements of the Intergovernmental Agreement.
Section 5. Board of Estimate and Contract Approval. Following the adoption of this Ordinance, the appropriate City officials are authorized to seek and obtain any approvals required by the Board of Estimate and Contract and any other governmental body having jurisdiction over the agreement.
Section 6. Severability. If any clause, sentence, paragraph, subdivision, section, or part of this Ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part thereof directly involved in the controversy in which such judgment shall have been rendered.
Section 7. Effective Date. This Ordinance shall take effect immediately upon its adoption by the City Council and subsequent approval by the Board of Estimate and Contract.
