RESOLVED, that an ordinance adopted by the City Council on February 14, 2024, and signed by the Mayor on February 15, 2024, authorizing the Mayor to retroactively enter into an agreement with the County of Westchester for ten (10) Parking Spaces (Lot 4, South Second Avenue), be and the same is hereby approved.

of Westchester for TEN (10) Parking Spaces
Whereas, by letter dated February 5, 2024, the Interim Commissioner for the Department of Public Safety has requested legislation authorizing the Mayor to retroactively enter into an agreement with the County of Westchester, permitting the County to utilize ten (10) parking spaces in the Mount Vernon Municipal Parking Lot #4 (South Second Avenue) as specified in the agreement; and
Whereas, the City of Mount Vernon acknowledges the request from the County of Westchester to utilize ten (10) parking spaces in the Mount Vernon Municipal Parking Lot #4 (South Second Avenue); and
Whereas, the County of Westchester seeks to use the aforementioned parking spaces from May 1, 2016, through April 30, 2026; and
Whereas, the retroactive agreement entails a monthly fee per parking space, with varying rates for different periods as outlined below:
The amount for May 1, 2016, through December 31, 2023, is $65.00 per space per month as shown below totaling $59,800.00 - owed to the City of Mount Vernon.

Whereas, the total amount due for the entire period from May 1, 2016, through April 30, 2026, amounts to $108,000.00; Now, Therefore, Be It Resolved That
The City of Mount Vernon, in City Council convened, does hereby ordain, and enact:
Section 1. Authorization for Agreement. The Mayor is hereby authorized to retroactively enter into an agreement with the County of Westchester, permitting the County to utilize ten (10) parking spaces in the Mount Vernon Municipal Parking Lot #4 (South Second Avenue) as specified in the agreement.
Section 2. Agreement Details. The agreement shall cover the period from May 1, 2016, through April 30, 2026, and shall include the specified monthly rates for each period as outlined in the whereas clauses of this ordinance.
Section 3. Payment Terms. The County of Westchester shall remit the agreed-upon monthly fees to the City of Mount Vernon for the duration of the agreement.
Section 4. Funds. Funds received shall be deposited into Budget Line A1720 (Parking Meter and Permit Fees).
Section 5. Implementation. The City Clerk is hereby authorized to execute all necessary documents and agreements related to this ordinance on behalf of the City of Mount Vernon.
Section 6. Effective Date. This ordinance shall take effect upon its approval by the Board of Estimate & Contract.
