AN ORDINANCE AMENDING ORDINANCE NO. 5,
ADOPTED BY THE CITY COUNCIL ON DECEMBER 27, 2023,
ENTITLED “AN ORDINANCE REQUESTING PERMISSION
FOR THE MAYOR TO ENTER INTO AN AGREEMENT WITH
THE US HOUSING AND URBAN DEVELOPMENT (“HUD”) AND
ACCEPT A COMMUNITY FUNDING GRANT IN THE AMOUNT
OF $1,500,000.00 FOR PROJECTS ENTITLED “OUTFALL
24 - SEWER SYSTEM CLEANING AND INVESTIGATION
AND SEWER SYSTEM REHABILITATION - PHASE 1”
The City of Mount Vernon, in City Council convened, does hereby ordain, and enact:
Section 1. The first decretal paragraph, and Section 2 of Ordinance No. [8] 5, adopted by the City Council on December 27, 2023, entitled “AN ORDINANCE REQUESTING PERMISSION FOR THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE US HOUSING AND URBAN DEVELOPMENT (“HUD”) AND ACCEPT A COMMUNITY FUNDING GRANT IN THE AMOUNT OF $1,500,000.00 FOR PROJECTS ENTITLED “OUTFALL 24 - SEWER SYSTEM CLEANING AND INVESTIGATION AND SEWER SYSTEM REHABILITATION - PHASE 1” is hereby amended as follows:
WHEREAS, by letter dated [May 1, 2023] [December 20, 2023], December 22, 2023, the Commissioner of the Department of Public Works requested legislation [to amend Ordinance No. 8, adopted by the City Council on May 10, 2023] to amend Ordinance No. 5, adopted by the City Council on December 27, 2023, authorizing the Mayor to enter into an agreement with the US Housing and Urban Development (“HUD”) to accept a Community Funding Grant, (Agreement # B-22-CP-NY-0662) in the amount of $1,500,000.00 for projects entitled “Outfall 24 Sewer System Cleaning and Investigation and Sewer System Rehabilitation - Phase 1.” The term of the contract shall commence on the date of execution by the Mayor and will remain in effect until August 31, 2030, unless extended by written agreement by either party; NOW, THEREFORE,
The City of Mount Vernon, in City Council convened, does hereby ordain, and enact:
Section 1. The Mayor is hereby authorized to enter into an agreement with the US Housing and Urban Development (HUD) to accept a Community Funding Grant, (Agreement # B-22-CP-NY-0662) in the amount of $1,500,000.00 for projects entitled “Outfall 24 Sewer System Cleaning and Investigation and Sewer System Rehabilitation - Phase 1.” The term of the contract shall commence on the date of execution by the Mayor and will remain in effect until August 31, 2030, unless extended by written agreement by either party.
Section 2. The funds will be deposited into Revenue Codes H4097-C939 and H4097 C944 (Federal Aid) to be appropriated to Budget Code H8120.203.C939 (Sanitary Sewer Expenditures) and H8140.203 C944 (Storm Sewer Expenditure) [H4097-C936 and H4097 C945 (Federal Aid) to be appropriated to Budget Code H8120.203.C936 (Sanitary Sewer Capital) and H8140.203 C945 (Storm Sewer Capital)] throughout the contract period.
Section 3. This ordinance shall take effect upon its approval by the Board of Estimate & Contract.
