A RESOLUTION AUTHORIZING
THE SETTLEMENT OF THE CLAIM OF
ANA DIMAS
WHEREAS, on May 5, 2026, a Notice of Claim was filed by Ana Dimas against the City of Mount Vernon, alleging that her 2015 Mercedes-Benz E350 sustained property damage when Fire Engine 206, after responding to an emergency incident in the City of Mount Vernon, struck her legally parked vehicle on Alden Place in Bronxville. The incident is alleged to have occurred on February 11, 2026, as Fire Department personnel were departing the emergency scene near the municipal boundary between the City of Mount Vernon and the Village of Bronxville; and
WHEREAS, the claimant sought reimbursement for the alleged property damage in the amount of Three Thousand Five Hundred Ninety-Two Dollars and Seventy-One Cents ($3,592.71); and
WHEREAS, the Office of the Corporation Counsel investigated and evaluated the claim and, by memorandum dated July 2, 2026, recommended that the Board of Estimate and Contract approve settlement of the claim in the amount of Three Thousand Five Hundred Ninety-Two Dollars and Seventy-One Cents ($3,592.71) as a fair and reasonable resolution of the matter.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Estimate and Contract of the City of Mount Vernon hereby authorizes the settlement of the claim filed by Ana Dimas in the amount of Three Thousand Five Hundred Ninety-Two Dollars and Seventy-One Cents ($3,592.71); and be it further
RESOLVED, that the Comptroller is hereby authorized and directed to disburse payment in the amount of Three Thousand Five Hundred Ninety-Two Dollars and Seventy-One Cents ($3,592.71) from Budget Code A1930.494 - Judgments and Settlements in the Fiscal Year 2026 Budget in full and final settlement of this claim.
